Terms of Use
These Terms of Use ("Terms") govern your use of the ARD Genix service at ardgenix.com and the ARD Genix and ARD Field mobile applications (together, the "Service") provided by Grynings LLC ("Grynings", "we", "us"). By creating an account or using the Service you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 years old to use the Service. You are responsible for keeping access to your e-mail account secure, because it is used to sign in to the Service, and for all activity under your account. Provide accurate information and keep it up to date.
2. The Service and our role
The Service is a software platform that lets customers request home repair and maintenance work from service companies, review estimates, schedule visits, communicate and pay. You acknowledge and agree that:
- Technology platform only. Grynings LLC provides exclusively the technology platform (the website and the Apps). Grynings LLC does not perform, supervise or guarantee any repair, installation or maintenance work.
- Independent service companies. The service companies and technicians available through the Service are independent contractors. They are not employees, agents, partners or representatives of Grynings LLC, and Grynings LLC does not control how they perform their work.
- Not a party to the repair contract. Any agreement for repair or maintenance work is made directly between you and the service company. Grynings LLC is not a party to that agreement. The work is performed under the service company's own terms, licenses, insurance and warranties.
- No responsibility for the work. To the fullest extent permitted by applicable law, Grynings LLC is not responsible for the quality, safety, legality, timing, cost or results of work performed by independent service companies, or for any damage, loss or injury arising from that work. Claims about the work must be addressed to the service company that performed it.
3. Payments
Payments made through the Service are processed by Stripe. Prices, deposits, cancellation terms and refunds are set by the service company and shown in the estimate before you approve it. You authorize charges for the amounts you approve in the Service.
4. Your content
You keep ownership of the photos, messages, voice notes and other content you upload. You grant Grynings LLC and the service company handling your job a non-exclusive license to use that content as needed to provide the Service. You must have the right to upload the content and it must not be illegal, abusive or infringing.
5. Acceptable use
You agree not to misuse the Service, including: accessing accounts or data that are not yours, interfering with the operation of the Service, reverse engineering the Apps, using the Service for unlawful purposes, or harassing other users, companies or technicians.
6. Location and notifications
Some features use your device's location and push notifications. You control these permissions in your device settings. Technician location is shared only while a visit is "on the way" and with the technician's consent, as described in our Privacy Policy.
7. Termination
You may delete your account at any time (see How to delete your account). We may suspend or terminate accounts that violate these Terms or create risk for other users.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by applicable law. Grynings LLC does not warrant that the Service will be uninterrupted, error-free or secure.
To the maximum extent permitted by applicable law, Grynings LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to the Service or to work performed by an independent service company. Grynings LLC's total liability for its own platform, for any claim related to the Service, is limited to the amount you paid to Grynings LLC in the 12 months before the claim, or USD 100, whichever is greater. These limitations apply to the fullest extent permitted by applicable law; some jurisdictions do not allow certain limitations, in which case they apply only to the extent allowed.
9. Changes
We may update these Terms. The "Last updated" date shows the latest revision. Continued use of the Service after changes take effect means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts located in Douglas County, Georgia.
